New York City Mayor Zohran Mamdani has walked back his earlier pledge to arrest Israeli Prime Minister Benjamin Netanyahu should he visit the city, acknowledging for the first time that New York has no legal authority to execute the International Criminal Court’s (ICC) arrest warrant against the Israeli leader.

The admission came in a video statement released by the mayor’s office on Wednesday, in which Mamdani said a comprehensive legal review by his administration found that municipal authorities cannot independently enforce the warrant issued by the Hague-based court.

“I have reviewed every avenue available. It is clear that we do not have the independent legal authority to enforce this warrant,” Mamdani said.

His statement marks a notable reversal from previous remarks in which he suggested that New York City would seek to act on the ICC warrant if Netanyahu entered the city.

Mayor Renews Attack on Israeli Leader

Although conceding the legal limitations of his office, Mamdani maintained his criticism of the Israeli Prime Minister, describing Netanyahu as a “war criminal” and accusing him of grave violations of international humanitarian law during Israel’s military campaign in Gaza.

The mayor alleged that Netanyahu bore responsibility for the deaths of more than 73,000 people, the injury of tens of thousands of children, and the obstruction of humanitarian assistance into the Palestinian enclave.

He also accused the Israeli leader of undermining ceasefire efforts in the conflict, arguing that the scale of destruction in Gaza justified international criminal prosecution.

“Anyone, with their eyes, with their heart, with their conscience, should recognize the devastation he has wrought and understand that he belongs before a court of law,” Mamdani said.

While acknowledging that his administration lacks the power to enforce the ICC warrant, the mayor declared that Netanyahu “is not welcome in New York City.”

He further urged the United States government to join the ICC and enforce the court’s warrant, recognising that only federal authorities possess the legal jurisdiction to arrest a foreign head of government on American soil.

Israel Fires Back

Mamdani’s remarks provoked an immediate response from Israel’s Ambassador to the United Nations, Danny Danon, who accused the mayor of promoting anti-Israel rhetoric and ignoring the atrocities committed by Hamas.

“Zohran Mamdani, enough. Enough with the blood libels. Enough with the attacks on Jewish organizations,” Danon said in a strongly worded statement.

The ambassador argued that the mayor should focus on governing New York City rather than engaging in what he described as politically motivated attacks against Israel.

The exchange adds to growing tensions between pro-Israel officials and progressive American politicians over the war in Gaza, which has sharply divided political opinion across the United States.

Trump Rejects ICC Warrant

The controversy also comes against the backdrop of a firm position taken by the White House.

Earlier this week, US President Donald Trump declared that Netanyahu would not be arrested while in the United States, dismissing any prospect of cooperation with the ICC.

“Benjamin Netanyahu will not be arrested, in any way, shape, or form, while in the United States of America,” Trump said.

The statement reinforces Washington’s longstanding position that the ICC has no jurisdiction over Israeli officials, as neither the United States nor Israel is a State Party to the Rome Statute that established the court.
