Declares Atiku Abubakar nomination illegal, upholds suit by Nafiu Bala Gombe

ABUJA — All candidates of the African Democratic Congress, ADC, for the 2027 general elections have been sacked following a judgment of the Federal High Court in Abuja which nullified the Senator David Mark-led leadership of the party.

Justice Peter Lifu, in a judgment delivered on Thursday, declared illegal the Senator Mark-led Caretaker Committee of the ADC and invalidated all actions taken on behalf of the party by the committee, including the nomination of former Vice President, Alhaji Atiku Abubakar, as the party’s presidential candidate.

Atiku, whose name had earlier been published by the Independent National Electoral Commission, INEC, as a candidate for the presidential poll scheduled for January 16, 2027, had since chosen former Governor of Rivers State, Rotimi Amaechi, as his running mate.

Justice Lifu held that the Caretaker Committee which organised the primary election that produced Atiku was illegally constituted, and therefore its actions were null and void.

The judgment was sequel to a suit marked FHC/ABJ/CS/1819/2025 filed by aggrieved former National Deputy Chairman (North-East) of the party, Nafiu Bala Gombe.

Gombe had approached the court to challenge the process through which the Senator Mark-led Committee took over leadership of the party after the resignation of former National Chairman, Chief Ralph Nwosu.

He contended that by virtue of his position and party constitution, he was qualified to assume leadership of the party following Nwosu’s resignation.

He prayed the court to nullify all actions taken by the Mark-led leadership and to restrain Senator Mark and former Osun State Governor, Ogbeni Rauf Aregbesola, from parading themselves as National Chairman and National Secretary respectively, on grounds that their emergence violated the party’s constitution and provisions of the Electoral Act.

Listed as defendants in the suit were the ADC, INEC, Senator Mark, Aregbesola and Chief Nwosu.

In his judgment, Justice Lifu found merit in the plaintiff’s case and granted all reliefs sought.

The verdict, if not reversed on appeal, effectively wipes out all nominations, including governorship, National Assembly and State Assembly candidates, conducted under the Mark-led executive.
